  1. ABOUT US AND THESE FAN REWARDS TERMS

    1. These Funko Fan Rewards Program Terms ("Fan Rewards Terms”) apply to your access to and participation in the Funko Fan Rewards Program (“Fan Rewards Program”).

    2. When you sign up to participate in the Funko Fan Rewards Program, you will enter into a legally binding contract as follows depending on where you are resident / domiciled:

      1. IF YOU ARE A CONSUMER RESIDENT / DOMICILED IN THE USA, CANADA OR MEXICO – you will enter into a legally binding contract with Funko, LLC which is a company registered in the State of Washington, USA under company number 602 469 782 and with its registered office at 2802 Wetmore Avenue, Everett, WA 98201, USA (“Funko US”).This means that Funko US is responsible for running and operating the Fan Rewards Program in your jurisdiction, and for all aspects of your individual participation in the Fan Rewards Program.

      2. IF YOU ARE A CONSUMER RESIDENT / DOMICILED IN THE UNITED KINGDOM (“UK”) OR EUROPEAN UNION (“EU”) - you will enter into a legally binding contract with a different entity - being Funko UK Limited which is a company registered in England and Wales under company number 10506769, with VAT number 260 5148 24, and with its registered office at 21 Holborn Viaduct, London, United Kingdom, EC1A 2DY (“Funko UK”). This means that Funko UK (not Funko US) is responsible for running and operating the Fan Rewards Program in your jurisdiction, and for all aspects of your individual participation in the Fan Rewards Program.

    3. In line with the foregoing, where we use the terms “Funko”, “we”, “our” or “us” in these Terms, we mean either Funko US, Funko UK, or both (depending on what the context requires, which will be clear from the drafting).

    4. Please read these Fan Rewards Terms carefully. These Fan Rewards Terms govern your use of and access to the Fan Rewards Program, and are in addition to your rights and obligations under our Terms & Conditions. By participating in the Fan Rewards Program, you agree to these Fan Rewards Terms and also to the Terms & Conditions. If you do not agree to these Fan Rewards Terms and the Terms & Conditions, do not participate in the Fan Rewards Program.

    5. Capitalized terms not defined in the Fan Rewards Terms have the meanings given to them in the Terms & Conditions. These Fan Rewards Terms are Supplemental Terms under the Terms & Conditions, and the Fan Rewards Program is a Service under the Terms & Conditions. To the extent there is a conflict between these Fan Rewards Terms and the Terms & Conditions as relevant to the operation of the Fan Rewards Program specifically, these Fan Rewards Terms will govern such conflict.

    6. Further, please note that we only use your personal information in accordance with our Privacy Policy.

    7. FOR CONSUMERS DOMICILED/RESIDENT IN THE USA, CANADA OR MEXICO (ONLY): THE TERMS & CONDITIONS REQUIRE THAT EXCEPT (I) FOR CERTAIN TYPES OF DISPUTES DESCRIBED IN SECTION 24 OF THE TERMS & CONDITIONS, (II) WHERE YOU EXERCISE YOUR RIGHT TO OPT OUT OF ARBITRATION AS DESCRIBED IN SECTION 24.12 OF THE TERMS & CONDITIONS, OR (III) TO THE EXTENT PROHIBITED BY LAW, DISPUTES BETWEEN YOU AND FUNKO WILL BE RESOLVED SOLELY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ARBITRATION, CLASS ACTION, ANY OTHER KIND OF REPRESENTATIVE PROCEEDING, OR BY JURY TRIAL.

  2. FAN REWARDS PROGRAM OVERVIEW

    The Fan Rewards Program is a customer loyalty program that is free of membership fees. It allows you to accumulate points (“Fan Rewards Points”) by completing eligible activities or making purchases as specified in Section 5 below. Fan Rewards Points may be redeemed in exchange for Fan Rewards, as specified in Section 6 of these Fan Rewards Terms. Fan Rewards Points expire in accordance with Section 8 below.

  3. ELIGIBILITY

    1. Consumers only. Only consumers may use our Fan Rewards Program, and the Fan Rewards Program is solely intended and made available for personal, non-commercial use. Corporations, associations, or other groups or legal entities, may not participate in the Fan Rewards Program. Each jurisdiction has its own definition for who constitutes a “consumer” but in principle you are a consumer if you are a natural person and if you are acting for purposes that are wholly or mainly outside of your trade, business, craft or profession.

    2. For the avoidance of doubt and insofar as is permitted by applicable law, Funko shall have no liability to any member for any loss of profit, loss of business, business interruption, or loss of business opportunity. This Section 3.2 does not apply to consumers resident / domiciled in Spain or Germany.

    3. Age. Users under eighteen (18) years of age (or the age of legal majority where the user lives) may only use our Fan Rewards Program under the supervision of a parent or legal guardian who agrees to be bound by these Fan Rewards Terms. The parent or legal guardian of a user under the age of eighteen (18) (or the age of legal majority) is fully responsible for the acts or omissions of such user in relation to our Fan Rewards Program. If you are a parent or legal guardian and you believe that your child under the age of eighteen (18) is using our Fan Rewards Program without your consent, please contact us at [email protected].

    4. Jurisdiction. You may only enroll in and use the Fan Rewards Program in jurisdictions authorized by us. Enrollment in and use of the Fan Rewards Program is currently authorized only in the United States, United Kingdom, France, Germany, Spain and some other EU countries (excluding at this time Italy) where Funko may choose to offer participation in the Fan Rewards Program in its sole discretion from time to time.

  4. YOUR INFORMATION / JOINING THE FAN REWARDS PROGRAM

    1. To enroll in the Fan Rewards Program, you must create or have an account with us and register for the Fan Rewards Program on our website at https://www.funko.com/fanrewards.

    2. Once enrolled in the Fan Rewards Program, you can view and manage your Fan Rewards Points through your account with us. For more information regarding your account and restrictions applicable to your account, please see our Terms & Conditions.

  5. EARNING FAN REWARDS POINTS

    1. You can start earning Fan Rewards Points once you have enrolled in the Fan Rewards Program by:

      1. participating in qualifying promotional activities or other opportunities that we may offer from time to time. Fan Rewards Points for participation in promotional activities will be awarded as described in the applicable promotional offer and relevant terms; and

      2. you may also be able to earn Fan Rewards Points by making qualifying purchases through our Services. Fan Rewards Points for purchases will be awarded as described in the relevant terms for the applicable purchase.

    2. Qualifying promotional offers and purchases may be subject to additional terms. Please review the additional terms applicable to each qualifying promotional offer and purchase. If the terms for a qualifying promotional offer or purchase conflict with these Fan Rewards Terms, the terms for the particular promotion offer will govern. Certain exclusions apply, as further described below in Section 5.4.

    3. Generally, Fan Rewards Points will be added to your account within twenty-four (24) hours of the occurrence and completion of the applicable promotional activity or purchase, unless an exclusion set forth below applies.

    4. Exclusions.

      1. Fan Rewards Points can only be earned for qualifying promotional activities that you have personally undertaken or qualifying purchases that you have personally made, unless otherwise indicated in writing by us.

      2. You cannot earn Fan Rewards Points on purchases of gift cards, tax, gratuities, promotional discounts, purchases made by redeeming your Fan Rewards, and other items as we may decide from time to time.

      3. Fan Rewards Points will not be awarded on fraudulent, returned, refunded, or cancelled promotional activities or purchases.

      4. If a promotional activity that earned you Fan Rewards Points is cancelled by you or you do not attend such promotional activity, of if you return or obtain a refund for an item that earned you Fan Rewards Points, then any Fan Rewards Points you accrued and that were added to your Fan Rewards Points balance from the applicable promotional activity or purchase will automatically be deducted from your Fan Rewards Points balance and removed from your account.

      5. Fan Rewards Points accumulated under the Fan Rewards Program are personal and promotional. This means that they have no cash value, cannot be sold, cannot be paid out to you in cash, and cannot be transferred to or redeemed/used by any other person.

      6. Fan Rewards Points may only be earned as stated in this Section 5 and may not be purchased (or earned in any other way).

  6. USING OR REDEEMING FAN REWARDS POINTS

    1. Fan Rewards Points may be redeemed for items or for promotional activities or other opportunities that we may offer from time to time (“Fan Rewards”). There may be a limited number of a particular Fan Reward available, and those Fan Rewards will be delivered on a first-come, first-served basis. Certain use restrictions apply, as further described below.

    2. Use restrictions.

      1. Fan Rewards Points cannot be used or redeemed on previous orders.

      2. It is also not possible to use or redeem Fan Rewards Points during the same transaction in which they were earned, unless specifically indicated by us in writing.

      3. You are responsible for any taxes related to any Fan Reward that is an item that you purchase with Fan Rewards Points.

      4. Fan Rewards may have certain restrictions including expiration dates and short, time-limited redemption periods that are governed by terms that are in addition to these Fan Rewards Terms. Please review the terms applicable to each Fan Reward carefully.

    3. Subject to us giving you at least thirty (30) days’ prior notice:

      1. The number of Fan Rewards Points required to redeem any Fan Reward may be substantially increased, any Fan Reward may be withdrawn, and restrictions on any Fan Reward or its redemption may be imposed by us or our designee, or the third-party business partner supplying the Fan Reward.

      2. We also reserve the right to substitute Fan Rewards of comparable or greater value if any redeemed Fan Reward becomes unavailable for any reason.

      3. Fan Rewards pictured in point-of-sale, online, television and print advertising, promotional packaging, and other Fan Rewards Program materials are for illustrative purposes only. The actual Fan Reward may vary from the Fan Reward pictured.

      4. This Section 6.3 does not apply to consumers resident in Germany.

  7. RETURNS, CANCELLATIONS, AND NO-SHOWS

    1. If you use or redeem Fan Rewards Points for a Fan Reward that is a good (rather than a service) - you may not return or obtain any refund or exchange for such goods.

    2. If you use or redeem Fan Rewards Points for a promotional activity which is cancelled by us (in the limited circumstances permitted by these Fan Reward Terms), any Fan Rewards Points that were deducted from your Fan Rewards Points balance for the applicable promotional activity will automatically be added back to your Fan Rewards Points balance. However, if you do not attend a promotional event for which you used or redeemed Fan Rewards Points, any Fan Rewards Points that were deducted from your Fan Rewards Points balance for the applicable promotional activity will NOT be added back to your Fan Rewards Points balance.

  8. FAN REWARDS POINTS - EXPIRATION AND DELETION

    1. Expiration

      1. To the extent that you do not earn or redeem any Fan Rewards Points for a period of one (1) year, all of your unused Fan Rewards Points will expire. Expired Fan Rewards Points are deducted from your Fan Rewards Points balance and removed from your Fan Rewards account. Funko will send an email to you, at the email address provided at the time of registration, thirty (30) days prior to the expiration date of Fan Rewards Points. FOR CONSUMERS DOMICILED IN GERMANY ONLY, THE FOLLOWING APPLIES INSTEAD OF THE FOREGOING: The expiration date is not one (1) year, but three (3) years starting from the end of the year in which you earned the relevant Fan Rewards Points that are subject to expiration.

      2. Also, see Section 9 below of these Fan Rewards Terms for information about the impact a suspension or termination of your enrollment in the Fan Rewards Program will have on your Fan Rewards Points.

      3. You can check the validity periods remaining on any of your Fan Rewards Points by contacting us at [email protected].

    2. Deletion. Funko may delete Fan Rewards Points from your account in the following circumstances and, except as provided below, without notice:

      1. If Fan Rewards Points have been credited as a result of your culpable breach of these Fan Rewards Terms (or our Terms & Conditions), for example, because of your misuse or fraudulent action.

      2. If Fan Rewards Points have been credited for an order/purchase that has been partially or fully refunded for any reason and in the case of a partial refund, only the Fan Rewards Points for the amount of the partial refund will be deducted.

  9. CHANGES TO THESE FAN REWARDS TERMS / THE FAN REWARDS PROGRAM

    1. We reserve the right to change or eliminate the Fan Rewards Program and all or any portion of these Fan Rewards Terms or any policy pertaining to the Fan Rewards Program at any time and in its discretion (if, for example, there is a change in the law or our operations). We may discontinue or change the benefits of the Fan Rewards Program or merge the Fan Rewards Program with another loyalty or rewards program (if, for example, there is a change in the law or our operations). In either of the foregoing cases, we will give you at least thirty (30) days’ prior notice before effecting any changes and we will post the amended Fan Rewards Terms and update the “Last updated” date above. If you do not agree to the amended Fan Rewards Terms, you must stop participating in the Fan Rewards Program - you shall have the option to decide whether you wish to continue in the Fan Rewards Program or terminate your membership (which you can do in your account or by contacting us at [email protected]). Your continued participation in the Fan Rewards Program after the expiry of the thirty (30) day notice will be deemed to amount to your confirmed acceptance of the changes.

    2. FOR CONSUMERS DOMICILED IN GERMANY: Section 9.1 does not apply to you and this Section 9.2applies to you instead. We may not change the Fan Rewards Program (including by discontinuing or changing the benefits of the Fan Rewards Program or merging the Fan Rewards Program with another loyalty or rewards program) or change these Fan Rewards Terms or any policy pertaining to the Fan Rewards Program without your agreement.

  10. TERMINATION AND SUSPENSION

    FOR CONSUMERS DOMICILED IN GERMANY, THE FOLLOWING APPLIES: Prior to exercising the rights under Section 10.1 (a)-(d), we will give you a warning notice specifying the alleged breach and granting you thirty (30) days from receipt of such notice within which you can cure such breach. We are entitled to exercise our termination rights under Section 10.1 (c) or (d) without a warning notice if the breach cannot, by its nature, be reasonably cured or if we cannot be reasonably expected to wait out a remedy period under the given circumstance, reasonably considering your interests and our interests. Your and our statutory rights to terminate for cause shall remain unaffected.

    1. If you breach any of these Fan Rewards Terms, we reserve our rights (subject to applicable law) to immediately do any or all of the following (without limitation):

      1. issue a warning to you;

      2. temporarily or permanently remove any User Content uploaded by you to the Services (if applicable);

      3. temporarily or permanently withdraw your right to use the Services including the Fan Rewards Program but also the Funko Services more broadly;

      4. suspend or terminate your Funko account;

      5. issue legal proceedings against you for reimbursement of all costs resulting from the breach (including, but not limited to, reasonable administrative and legal costs);

      6. take further legal action against you; and/or

      7. disclose such information to law enforcement authorities as necessary (subject to applicable data protection laws).

    2. You may also terminate or cancel your enrollment in the Fan Rewards Program at any time by contacting us in accordance with Section 11 below.

    3. If your enrollment in the Fan Rewards Program is suspended or terminated for any other reason (whether by you or by us) in accordance with these Fan Rewards Terms, it will result in the suspension or termination of your ability to participate in the Fan Rewards Program. If your participation in the Fan Rewards Program is terminated, you will not be able to redeem any accumulated Fan Rewards Points and your Fan Rewards Points will be deleted from your account.

  11. COMPLAINTS, LIABILITY, DISPUTE RESOLUTION, GOVERNING LAW AND JURISDICTION

    1. For any dispute or claim that you have against Funko, that Funko has against you or that you have, or Funko has, in each case relating in any way to these Fan Rewards Terms or the Fan Rewards Program, or any aspect of the relationship between you and Funko as relates to these Fan Rewards Terms or the Fan Rewards Program, you agree that the provisions set out in the Terms & Conditions apply.

Estos Fan Rewards Terms regulan su uso y acceso al FUNKO FAN REWARDS PROGRAM, y se suman a sus derechos y obligaciones en virtud de nuestros Términos y Condiciones. Al participar en el FUNKO FAN REWARDS PROGRAM, usted acepta estos Fan Rewards Terms y también los Términos y Condiciones.     5. 1.5. Los términos en mayúscula no definidos en los Fan Rewards Terms tendrán el significado que se les asigna en los Términos y Condiciones. Estos Fan Rewards Terms son Términos Suplementarios en virtud de los Términos y Condiciones, y el Fan Rewards Program es un Servicio conforme a los Términos y Condiciones. En la medida en que exista un conflicto entre estos Fan Rewards Terms y los Términos y Condiciones en lo relativo al funcionamiento específico del FUNKO FAN REWARDS PROGRAM, prevalecerán estos Fan Rewards Terms.

    7. 1.7. PARA CONSUMIDORES RESIDENTES/DOMICILIADOS EN EE. UU., CANADÁ O MÉXICO (ÚNICAMENTE): LOS TÉRMINOS Y CONDICIONES RESTABLECEN QUE, SALVO (I) PARA CIERTOS TIPOS DE DISPUTAS DESCRITAS EN LA SECCIÓN 24 DE LOS TÉRMINOS Y CONDICIONES, II) CUANDO USTED EJERZA SU DERECHO A EXCLUIRSE DEL ARBITRAJE SEGÚN LO DESCRITO EN LA SECCIÓN 24.12 DE LOS TÉRMINOS Y CONDICIONES, O (III) EN LA MEDIDA EN QUE LO PROHÍBA LA LEY, LAS DISPUTAS ENTRE USTED Y FUNKO SE RESOLVERÁN ÚNICAMENTE DE FORMA INDIVIDUAL Y NO COMO ARBITRAJE COLECTIVO, DEMANDA COLECTIVA, CUALQUIER OTRO TIPO DE PROCEDIMIENTO REPRESENTATIVO O MEDIANTE JURADO.

  2. DESCRIPCIÓN GENERAL DEL FAN REWARDS PROGRAM

    El Fan Rewards Program es un programa de fidelización de clientes que no tiene cuotas de membresía. Permite acumular puntos (“Fan Rewards Points”) al completar actividades elegibles o realizar compras, según lo especificado en la Sección 5 correspondiente más abajo. Los Fan Rewards Points pueden canjearse a cambio de Fan Rewards, tal como se indica en la Sección 6 de estos Fan Rewards Terms. Los Fan Rewards Points caducan conforme a lo establecido en la Sección correspondiente.

  3. ELEGIBILIDAD

    1. Solo consumidores. Únicamente los consumidores pueden utilizar nuestro Fan Rewards Program, y el Fan Rewards Program está destinado y disponible exclusivamente para un uso personal y no comercial. Las corporaciones, asociaciones u otros grupos o entidades legales no pueden participar en el Fan Rewards Program. Cada jurisdicción cuenta con su propia definición de quién constituye un “consumidor”, pero en principio usted será considerado consumidor si es una persona física y actúa con fines que están total o principalmente fuera de su actividad comercial, empresarial, artesanal o profesional.

    2. Para evitar dudas y en la medida en que lo permita la legislación aplicable, Funko no tendrá ninguna responsabilidad frente a ningún miembro por pérdida de beneficios, pérdida de negocio, interrupción de negocio o pérdida de oportunidad comercial. Esta Sección 3.2 no se aplica a los consumidores residentes o domiciliados en España o Alemania.

    3. Edad. Los usuarios menores de dieciocho (18) años de edad (o de la edad de mayoría legal en el lugar en el que residan) solo podrán utilizar nuestro FAN REWARDS PROGRAM bajo la supervisión de uno de sus padres o de su tutor legal, quien deberá aceptar quedar vinculado por los presentes Términos del Fan Rewards Program. El padre, la madre o el tutor legal de un usuario menor de dieciocho (18) años (o de la edad de mayoría legal) será plenamente responsable de los actos u omisiones de dicho usuario en relación con nuestro Fan Rewards Program. Si usted es padre, madre o tutor legal y considera que su hijo menor de dieciocho (18) años está utilizando nuestro Fan Rewards Program sin su consentimiento, le rogamos que se ponga en contacto con nosotros en: [email protected].

    4. Jurisdicción. Usted solo podrá inscribirse y utilizar el Fan Rewards Program en aquellas jurisdicciones autorizadas por nosotros. Actualmente, la inscripción y el uso del Fan Rewards Program están autorizados únicamente en Estados Unidos, Canadá, México, Reino Unido, Francia, Alemania, España y algunos otros países de la Unión Europea (excluida, por el momento, Italia), en los que Funko podrá decidir, a su entera discreción y en cualquier momento, ofrecer la participación en el Fan Rewards Program.

  4. SU INFORMACIÓN / INSCRIPCIÓN EN EL FAN REWARDS PROGRAM

    1. Para inscribirse en el Fan Rewards Program, usted debe crear o tener una cuenta con nosotros y registrarse en el Fan Rewards Program a través de nuestro sitio web en https://www.funko.com/fanrewards.

    2. Una vez inscrito en el Fan Rewards Program, usted podrá visualizar y gestionar sus Fan Rewards Points a través de su cuenta con nosotros. Para obtener más información respecto de su cuenta y las restricciones aplicables a la misma, consulte nuestros Términos y Condiciones.

  5. OBTENCIÓN DE FAN REWARDS POINTS

    1. Usted podrá comenzar a obtener Fan Rewards Points una vez inscrito en el Fan Rewards Program mediante:

      1. la participación en actividades promocionales calificadas u otras oportunidades que podamos ofrecer ocasionalmente. Los Fan Rewards Points por participación en actividades promocionales se otorgarán según lo descrito en la oferta promocional correspondiente y en los términos aplicables; y

      2. la realización de compras calificadas a través de nuestros Servicios. Los Fan Rewards Points por compras se otorgarán conforme a lo establecido en los términos correspondientes para la compra aplicable.

    2. Las ofertas promocionales y las compras calificadas podrán estar sujetas a términos adicionales. Le rogamos revise los términos adicionales aplicables a cada oferta promocional o compra calificada. En caso de conflicto entre los términos de una oferta promocional o compra calificada y estos Fan Rewards Terms, prevalecerán los términos de la oferta o compra específica. Ciertas exclusiones aplican, según se describe más adelante en la Sección 5.4.

    3. En términos generales, los Fan Rewards Points serán añadidos a su cuenta dentro de las veinticuatro (24) horas siguientes a la realización y conclusión de la actividad promocional o compra aplicable, salvo que proceda alguna exclusión prevista más abajo.

    4. Exclusiones.

      1. Los Fan Rewards Points solo podrán obtenerse por actividades promocionales calificadas que usted haya realizado personalmente o por compras calificadas que usted haya efectuado personalmente, salvo que le indiquemos lo contrario por escrito.

      2. No podrá obtener Fan Rewards Points en la compra de tarjetas regalo, impuestos, propinas, descuentos promocionales, compras realizadas mediante el canje de sus Fan Rewards, ni en otros supuestos que podamos determinar ocasionalmente.

      3. No se otorgarán Fan Rewards Points por actividades promocionales o compras fraudulentas, devueltas, reembolsadas o canceladas.

      4. Si una actividad promocional que le generó Fan Rewards Points es cancelada por usted, o si usted no asiste a dicha actividad promocional, o si devuelve u obtiene un reembolso de un artículo que le otorgó Fan Rewards Points, entonces los Fan Rewards Points que hubiera acumulado y que hubiesen sido añadidos a su saldo de Fan Rewards Points por dicha actividad promocional o compra serán automáticamente deducidos de su saldo y eliminados de su cuenta.

      5. Los Fan Rewards Points acumulados en el marco del Fan Rewards Program son personales y de carácter promocional. Esto significa que no tienen valor monetario, no pueden venderse, no pueden abonarse en efectivo a su favor, y no pueden transferirse ni canjearse/ser utilizados por ninguna otra persona.

      6. Los Fan Rewards Points solo podrán obtenerse de la manera prevista en la presente Sección 5 y no podrán comprarse (ni obtenerse de ninguna otra forma).

  6. USO O CANJEO DE LOS FAN REWARD POINTS

    1. Los Fan Rewards Points pueden canjearse por artículos o por actividades promocionales u otras oportunidades que podamos ofrecer ocasionalmente (los “Fan Rewards”). Puede existir un número limitado de un Fan Reward determinado, y dichos Fan Rewards se entregarán por orden de solicitud. Se aplican ciertas restricciones de uso, según se describe a continuación.

    2. Restricciones de uso.

      1. Los Fan Rewards Points no pueden utilizarse ni canjearse en pedidos previos.

      2. Tampoco es posible utilizar o canjear Fan Rewards Points durante la misma transacción en la que se obtuvieron, salvo indicación expresa nuestra por escrito.

      3. Usted es responsable de cualquier impuesto relacionado con cualquier Fan Reward que consista en un artículo que usted adquiera mediante Fan Rewards Points.

      4. Los Fan Rewards pueden estar sujetos a ciertas restricciones, incluidas fechas de vencimiento y períodos de canje breves y limitados en el tiempo, regidos por términos adicionales a estos Fan Rewards Terms. Revise atentamente los términos aplicables a cada Fan Reward.

    3. Con sujeción a que le proporcionemos un preaviso de al menos treinta (30) días:

      1. La cantidad de Fan Rewards Points necesaria para canjear cualquier Fan Reward puede incrementarse sustancialmente; cualquier Fan Reward puede retirarse; y podrán imponerse restricciones sobre cualquier Fan Reward o su canje por nosotros o por nuestro designado, o por el socio comercial tercero que suministre el Fan Reward.

      2. También nos reservamos el derecho de sustituir Fan Rewards de valor comparable o superior si cualquier Fan Reward canjeado deja de estar disponible por cualquier motivo.

      3. Los Fan Rewards mostrados en el punto de venta, en línea, en publicidad televisiva e impresa, en empaques promocionales y en otros materiales del Fan Rewards Program son meramente ilustrativos. El Fan Reward real puede diferir del mostrado. Esta Sección no se aplica a consumidores residentes en Alemania.

      4. Esta Sección 6.3 no se aplica a los consumidores residentes en Alemania.

  7. DEVOLUCIONES, CANCELACIONES Y NO ASISTENCIAS

    1. 7Si usted utiliza o canjea Fan Rewards Points por un Fan Reward que sea un bien (y no un servicio), no podrá devolverlo ni obtener reembolso o cambio por dichos bienes.

    2. Si usted utiliza o canjea Fan Rewards Points por una actividad promocional que sea cancelada por nosotros (en las limitadas circunstancias permitidas por estos Fan Rewards Terms), cualquier Fan Rewards Points deducido de su saldo por la actividad promocional aplicable se añadirá automáticamente de nuevo a su saldo de Fan Rewards Points. Sin embargo, si usted no asiste a un evento promocional para el cual utilizó o canjeó Fan Rewards Points, los Fan Rewards Points deducidos de su saldo por la actividad promocional aplicable NO se restituirán a su saldo de Fan Rewards Points.

  8. FAN REWARDS POINTS - VENCIMIENTO Y ELIMINACIÓN

    1. Vencimiento.

      1. En la medida en que usted no obtenga ni canjee Fan Rewards Points durante un período de un (1) año, todos sus Fan Rewards Points no utilizados vencerán. Los Fan Rewards Points vencidos se deducen de su saldo de Fan Rewards Points y se eliminan de su cuenta de Fan Rewards. Funko le enviará un correo electrónico, a la dirección facilitada en el momento del registro, treinta (30) días antes de la fecha de vencimiento de los Fan Rewards Points.       2. Asimismo, consulte la Sección 9 correspondiente más abajo de estos Fan Rewards Terms para obtener información acerca del impacto que una suspensión o terminación de su inscripción en el Fan Rewards Program tendrá sobre sus Fan Rewards Points./p>

      3. Puede comprobar los períodos de validez restantes de cualquiera de sus Fan Rewards Points contactándonos en [email protected].

    2. Eliminación. Funko podrá eliminar Fan Rewards Points de su cuenta en las siguientes circunstancias y, salvo lo indicado a continuación, sin previo aviso:

      1. Si los Fan Rewards Points se han abonado como resultado de un incumplimiento imputable por su parte de estos Fan Rewards Terms (o de nuestros Términos y Condiciones), por ejemplo, debido a uso indebido o a una actuación fraudulenta.

      2. Si los Fan Rewards Points se han abonado por un pedido/compra que haya sido reembolsado total o parcialmente por cualquier motivo; en caso de reembolso parcial, solo se deducirán los Fan Rewards Points correspondientes al importe reembolsado.

  9. CAMBIOS A ESTOS FAN REWARDS TERMS / AL FAN REWARDS PROGRAM

    1. Nos reservamos el derecho a modificar o eliminar el Fan Rewards Program y la totalidad o cualquier parte de estos Fan Rewards Terms o de cualquier política relativa al Fan Rewards Program en cualquier momento y a nuestra discreción (por ejemplo, si se produce un cambio legislativo o en nuestras operaciones). Podemos interrumpir o modificar las prestaciones del Fan Rewards Program o fusionar el Fan Rewards Program con otro programa de fidelización o recompensas (por ejemplo, si se produce un cambio legislativo o en nuestras operaciones). En cualquiera de los casos anteriores, le daremos un preaviso mínimo de treinta (30) días antes de efectuar cualquier cambio, y publicaremos los Fan Rewards Terms modificados y actualizaremos la fecha de “Última actualización” indicada más arriba. Si usted no está de acuerdo con los Fan Rewards Terms modificados, deberá dejar de participar en el Fan Rewards Program: tendrá la opción de decidir si desea continuar en el Fan Rewards Program o dar por terminada su membresía (lo cual puede hacer desde su cuenta o contactándonos en [email protected]). Su participación continuada en el Fan Rewards Program tras el vencimiento del preaviso de treinta (30) días se considerará como aceptación de los cambios.

    2. PARA CONSUMIDORES DOMICILIADOS EN ALEMANIA: La Sección 9.1 no se aplica a usted y, en su lugar, rige esta Sección 9.2. No podremos modificar el Fan Rewards Program (incluida su interrupción, el cambio de prestaciones o la fusión con otro programa) ni modificar estos Fan Rewards Terms o cualquier política relativa al Fan Rewards Program sin su conformidad.

  10. TERMINACIÓN Y SUSPENSIÓN

    1. Si usted incumple cualquiera de estos Fan Rewards Terms, nos reservamos (con sujeción a la ley aplicable) el derecho a realizar de inmediato cualquiera o todas las siguientes acciones (sin limitación):

      1. emitirle una advertencia;

      4. suspender o cancelar su cuenta Funko;

      5. iniciar procedimientos legales en su contra para obtener el reembolso de todos los costes derivados del incumplimiento (incluidos, entre otros, los costes administrativos y legales razonables);

      6. emprender acciones legales adicionales en su contra; y/o

      7. revelar la información correspondiente a las autoridades encargadas de hacer cumplir la ley cuando sea necesario (con sujeción a las leyes aplicables de protección de datos).

        8. PARA CONSUMIDORES DOMICILIADOS, RIGE LO SIGUIENTE: Antes de ejercer los derechos previstos en la Sección 10.1 (a)-(d), le remitiremos un requerimiento especificando el presunto incumplimiento y concediéndole treinta (30) días desde la recepción del requerimiento para subsanar dicho incumplimiento. Podremos ejercer nuestros derechos de terminación con arreglo a la Sección 10.1 (c) o (d) sin requerimiento previo si el incumplimiento no puede, por su naturaleza, subsanarse razonablemente o si no puede razonablemente esperarse que aguardemos un período de subsanación dadas las circunstancias, considerando de forma razonable sus intereses y los nuestros. Sus derechos y los nuestros de terminación legal por causa justificada permanecerán inalterados.

    2. Usted también puede terminar o cancelar su inscripción en el Fan Rewards Program en cualquier momento, contactándonos conforme a la Sección 11 más abajo.

    3. Si su inscripción en el Fan Rewards Program se suspende o termina por cualquier otro motivo (ya sea por usted o por nosotros) de conformidad con estos Fan Rewards Terms, ello dará lugar a la suspensión o terminación de su capacidad para participar en el Fan Rewards Program. Si su participación en el Fan Rewards Program se da por terminada, usted no podrá canjear los Fan Rewards Points acumulados y sus Fan Rewards Points serán eliminados de su cuenta.

  11. RECLAMACIONES, RESPONSABILIDAD, RESOLUCIÓN DE DISPUTAS, LEY APLICABLE Y JURISDICCIÓN

    1. Para cualquier disputa o reclamación que usted tenga contra Funko, que Funko tenga contra usted, o que usted o Funko tengan, en cada caso relacionada de cualquier modo con estos Fan Rewards Terms o con el Fan Rewards Program, o con cualquier aspecto de la relación entre usted y Funko en relación con estos Fan Rewards Terms o con el Fan Rewards Program, usted acepta que se aplicarán las disposiciones establecidas en los Términos y Condiciones

F(UNIQUEMENT) POUR LES CONSOMMATEURS DOMICILIÉS / RÉSIDANT AUX ÉTATS-UNIS, AU CANADA OU AU MEXIQUE : LES CONDITIONS GÉNÉRALES EXIGENT QUE, SAUF (I) POUR CERTAINS TYPES DE CONFLITS, TELS QUE PRÉVUS À L’ARTICLE 24 DES CONDITIONS GÉNÉRALES, II) SI VOUS EXERCEZ VOTRE DROIT DE RENONCER À L’ARBITRAGE, COMME PRÉVU À L’ARTICLE 24.12 DES CONDITIONS GÉNÉRALES, OU (III) DANS LA MESURE INTERDITE PAR LA LOI, LES CONFLITS ENTRE VOUS ET FUNKO NE SERONT RÉGLÉS QU’À TITRE INDIVIDUEL ET NON PAR LE BIAIS D’UN ARBITRAGE COLLECTIF, D’UN RECOURS COLLECTIF ET DE TOUTE AUTRE PROCÉDURE COLLECTIVE, OU PAS PROCÈS DEVANT JURY.

  2. APERÇU DU FAN REWARDS PROGRAM

    Le Fan Rewards Program est un programme de fidélisation des clients sans frais d’adhésion. Il vous permet d’accumuler des points (« Points du Fan Rewards Program ») en réalisant des activités admissibles ou en faisant des achats de la manière prévue à l'article 5 ci-dessous. Les Points du Fan Rewards Program peuvent être utilisés contre des Fan Rewards, comme indiqué à l'article 6 des présentes Conditions du Fan Rewards Program. Les Points du Fan Rewards Program expirent en conformité avec les dispositions de l'article 8 ci-dessous.

  3. ADMISSIBILITÉ

    1. Uniquement pour les consommateurs. Uniquement les consommateurs peuvent utiliser notre Fan Rewards Program et le Fan Rewards Program n’est destiné et n’est rendu disponible qu’à des fins d’utilisation personnelle, non commerciale. La participation des sociétés, des associations ou d’autres groupes ou entités juridiques au Fan Rewards Program est interdite.     2. Pour éviter toute ambiguïté et dans la mesure autorisée par la législation en vigueur, Funko décline toute responsabilité envers n’importe quel membre quant à la perte de profits, la perte d'activité, la perte d’exploitation ou la perte d’opportunités d'affaires. Cet article 3.2 ne s’applique pas aux consommateurs résidant / domiciliés en Espagne ou en Allemagne.

    3. Âge. Les utilisateurs âgés de moins de dix-huit (18) ans (ou l’âge de la majorité légale dans le pays où l’utilisateur vit) ne peuvent utiliser notre Fan Rewards Program que sous la supervision d’un parent ou d’un tuteur légal qui accepte d’être lié par ces Conditions du Fan Rewards Program.     1. Pour vous inscrire au Fan Rewards Program, vous devez créer ou avoir un compte ouvert auprès de nous et vous inscrire au Fan Rewards Program sur notre site Web à l'adresse https://www.funko.com/fanrewards.

    2. Une fois inscrit(e) au Fan Rewards Program, vous pouvez consulter et gérer vos Points du Fan Rewards Program dans le compte ouvert auprès de nous. Pour en savoir plus sur votre compte et les restrictions applicables à votre compte, veuillez consulter nos Conditions générales.

  5. GAGNER DES POINTS DU FAN REWARDS PROGRAM

    1. Vous pouvez commencer à gagner des Points du Fan Rewards Program après votre inscription au Fan Rewards Program :

      1. en participant à des activités promotionnelles qualifiantes ou à d’autres opportunités que nous proposons de temps en temps. Les Points du Fan Rewards Program pour participer à des activités promotionnelles seront accordés comme prévu à l’offre promotionnelle applicable et à ses conditions pertinentes ; et

      2. vous pouvez également gagner Points du Fan Rewards Program en faisant des achats admissibles au moyen de nos Services. Les Points du Fan Rewards Program pour des achats seront accordés comme prévu aux conditions pertinentes pour les achats applicables.

    2. Les offres et les achats promotionnels admissibles peuvent faire l’objet de conditions supplémentaires. Veuillez consulter les conditions supplémentaires applicables à chaque offre et achat promotionnel admissible. Si les conditions d’une offre ou d’un achat promotionnel admissible entrent en conflit avec les présentes Conditions du Fan Rewards Program, les conditions de l’offre promotionnelle particulière prévaudront. Certaines exclusions s’appliquent comme prévu à l'article 5.4.

    3. Généralement, des Points du Fan Rewards Program seront ajoutés à votre compte dans les vingt-quatre (24) heures suivant l’occurrence et l'achèvement de l'activité ou de l'achat promotionnel applicable, à moins qu’une exclusion prévue ci-après ne s’applique.

    4. Exclusions.

      1. Des Points du Fan Rewards Program ne peuvent être gagnés que pour des activités promotionnelles admissibles que vous réalisez personnellement ou pour des achats admissibles que vous faites personnellement, sauf indication contraire écrite fournie par nous.

      2. Vous ne pouvez pas gagner de Points du Fan Rewards Program pour des achats de cartes cadeaux, des impôts, des gratuités, des rabais promotionnels, des achats faits en utilisant vos Fan Rewards, et d’autres articles que nous pouvons désigner à notre discrétion, de temps en temps.

      3. Les Points du Fan Rewards Program ne peuvent pas être accordés pour des activités ou des achats promotionnels frauduleux, retournés, remboursés ou annulés.

      4. Si une activité promotionnelle qui vous a permis d'accumuler des Points du Fan Rewards Program est annulée par vous ou si vous ne participez pas à une telle activité promotionnelle, ou si vous retournez ou obtenez le remboursement d’un article qui vous a permis de gagner des Points du Fan Rewards Program, tous les Points du Fan Rewards Program que vous avez accumulés et qui ont été ajoutés à votre solde de Points du Fan Rewards Program suite à l'activité ou à l'achat promotionnel applicable seront retenus automatiquement de votre solde de Points du Fan Rewards Program et supprimés de votre compte.

      5. Les Points du Fan Rewards Program accumulés au titre du Fan Rewards Program sont personnels et promotionnels. Cela signifie qu’ils n’ont pas de valeur de rachat, ils ne peuvent pas être vendus, payés à vous en espèces et transférés à aucune autre personne ou échangés / utilisés par aucune autre personne.

      6. Les Points du Fan Rewards Program ne peuvent être gagnés que de la manière énoncée au présent article 5 et ne peuvent pas être achetés (ou gagnés de n’importe quelle autre façon).

  6. UTILISER OU ÉCHANGER DES POINTS DU FAN REWARDS PROGRAM

    1. Les Points du Fan Rewards Program peuvent être échangés contre des articles ou des activités promotionnels ou contre toutes autres opportunités que nous pouvons proposer de temps en temps (« Fan Rewards »). Il peut y avoir un nombre limité de Fan Rewards disponibles et ces Fan Rewards seront accordés selon le principe du premier arrivé, premier servi.     2. Restrictions d’utilisation.

      4. Les Fan Rewards peuvent être accompagnés de certaines restrictions, y compris des dates d’expiration et de courtes périodes d’échange à durée limitée, qui sont régies par les conditions qui s’ajoutent aux présentes Conditions du Fan Rewards Program.     3. Sous réserve d’un préavis d’au moins trente (30) jours de votre part :

Le nombre de Points du Fan Rewards Program nécessaires pour échanger tout Fan Reward peut augmenter considérablement, tout Fan Reward peut être retiré et des restrictions peuvent être imposées sur tout Fan Reward ou son échange par nous ou notre représentant, ou par tout partenaire commercial tiers qui fournit le Fan Reward.

      2. Nous nous réservons également le droit de remplacer tout Fan Reward ayant une valeur comparable ou supérieure si le Fan Reward réclamé devient indisponible pour quelque motif que ce soit.

      3. Les Fan Rewards présentés dans les points de vente, en ligne, à la télé et dans les annonces imprimées, les emballages promotionnels et d’autres documents du Fan Rewards Program sont à titre indicatif seulement. Le Fan Reward effectif peut être différent du Fan Reward présenté.

      4. Cet article 6.3 ne s’applique pas aux consommateurs résidant en Allemagne.

  7. RETOURS, ANNULATIONS ET NON-PRÉSENTATIONS

    1. Si vous utilisez ou échangez des Points du Fan Rewards Program pour un Fan Reward représentant un bien (pas un service) - vous ne pouvez pas retourner ce bien ou obtenir un remboursement ou un échange.

    2. Si vous utilisez ou échangez des Points du Fan Rewards Program pour une activité promotionnelle qui est annulée par nous (dans les circonstances limitées autorisées par ces Conditions du Fan Reward ProGram), tous Points du Fan Rewards Program retenus de votre solde de Points du Fan Rewards Program pour l'activité promotionnelle applicable seront automatiquement rajoutés à votre solde de Points du Fan Rewards Program. Mais si vous ne participez pas à un événement promotionnel pour lequel vous avez utilisé ou échangé des Points du Fan Rewards Program, tous Points du Fan Rewards Program retenus de votre solde de Points du Fan Rewards Program pour l'activité promotionnelle applicable NE seront pas rajoutés à votre solde de Points du Fan Rewards Program.

  8. POINTS DU FAN REWARDS PROGRAM - EXPIRATION ET SUPPRESSION

    1. Expiration

      1. Dans la mesure où vous ne gagnez ou n’échangez pas de Points du Fan Rewards Program au cours d’une période d’un (1) an, tous vos Points inutilisés du Fan Rewards Program expirent. Les Points expirés du Fan Rewards Program sont retenus de votre solde de Points du Fan Rewards Program et supprimés de votre compte Fan Rewards. Funko vous enverra un courriel à l’adresse électronique fournie lors de votre inscription, dans les trente (30) jours avant la date d’expiration des Points du Fan Rewards Program. UNIQUEMENT POUR LES CONSOMMATEURS DOMICILIÉS EN ALLEMAGNE, LES RÈGLES SUIVANTES S’APPLIQUENT AU LIEU DE CE QUI PRÉCÈDE : La date d’expiration n'est pas d’un (1) an, mais de trois (3) ans à compter après la fin de l’année au cours de laquelle vous avez gagné les Points du Fan Rewards Program faisant l’objet de l’expiration.

      2. De plus, veuillez consulter l'article 9 ci-dessous des présentes Conditions du Fan Rewards Program pour obtenir des informations sur l’impact qu’une suspension ou une résiliation de votre adhésion au Fan Rewards Program aura sur vos Points du Fan Rewards Program.

      3. Vous pouvez vérifier les périodes de validité restantes de vos Points du Fan Rewards Program en nous contactant à l'adresse [email protected].

    2. Suppression. Funko peut supprimer des Points du Fan Rewards Program de votre compte dans les circonstances suivantes et, sous réserve des dispositions ci-dessous, sans préavis :

      1. Si des Points du Fan Rewards Program ont été crédités suite à une violation de votre part de ces Conditions du Fan Rewards Program (ou de nos Conditions générales), par exemple, en raison de votre usage abusif ou acte frauduleux.

      2. Si des Points du Fan Rewards Program ont été crédités pour une commande / un achat qui a été partiellement ou entièrement remboursé pour quelque motif que ce soit et dans l’éventualité d’un remboursement partiel, seuls les Points du Fan Rewards Program pour le montant du remboursement partiel seront retenus.

  9. MODIFICATIONS À CES CONDITIONS DU FAN REWARDS PROGRAM / AU FAN REWARDS PROGRAM

    1. Nous nous réservons le droit de modifier ou de supprimer le Fan Rewards Program et la totalité ou une partie quelconque de ces Conditions du Fan Rewards Program ou de toute politique relative au Fan Rewards Program, en tout temps et à notre discrétion (si, par exemple, la loi ou nos activités subissent des modifications). Nous pouvons supprimer ou modifier les avantages du Fan Rewards Program ou fusionner le Fan Rewards Program avec un autre programme de fidélité ou de récompenses (si, par exemple, la loi ou nos activités subissent des modifications). Dans n’importe quel des cas susmentionnés, nous vous donnerons un préavis d’au moins trente (30) jours avant d’effectuer des modifications et nous publierons les Conditions amendées du Fan Rewards Program et mettrons à jour la « Date de la dernière mise à jour" » indiquée en haut du document. Si vous n’acceptez pas les Conditions amendées du Fan Rewards Program, vous devez cesser de participer au Fan Rewards Program - vous aurez l’option de décider si vous souhaitez continuer le Fan Rewards Program ou résilier votre adhésion (ce que vous pouvez faire dans votre compte ou en nous contactant à l'adresse [email protected]). La continuation de votre participation au Fan Rewards Program après l’expiration du préavis de trente (30) jours sera réputée comme confirmant votre acceptation de ces modifications.

    2. POUR LES CONSOMMATEURS DOMICILIÉS EN ALLEMAGNE : L'article 9.1 ne s’applique pas à vous, mais le présent article 9.2s’applique à vous. Nous ne pouvons pas modifier le Fan Rewards Program (notamment en supprimant ou en modifiant les avantages du Fan Rewards Program ou en fusionnant le Fan Rewards Program avec un autre programme de fidélité ou de récompenses) ou modifier ces Conditions du Fan Rewards Program ou toute politique relative au Fan Rewards Program sans votre accord.

  10. RÉSILIATION ET SUSPENSION

    1. Si vous violez l’une quelconque de ces Conditions du Fan Rewards Program, nous nous réservons le droit (sous réserve de la législation en vigueur) de prendre immédiatement l’une ou l’ensemble des mesures suivantes (sans limitation) :

      1. vous donner un avertissement ;

      2. supprimer de façon temporaire ou permanente tout Contenu utilisateur téléchargé par vous aux Services (le cas échéant) ;

      3. retirer de façon temporaire ou permanente votre droit d’utiliser les Services, y compris le Fan Rewards Program, ainsi que les Services Funko, d’une façon plus générale ;

      4. suspendre ou résilier votre compte Funko ;

      5. engager des poursuites judiciaires contre vous pour le remboursement de tous les coûts découlant de la violation (incluant, sans s’y limiter, des coûts administratifs et juridiques raisonnables ) ;

      6. intenter d’autres actions judiciaires contre vous ; et/ou

      7. divulguer des informations aux autorités de police, le cas échéant (sous réserve des lois en vigueur en matière de protection des données).

      2. POUR LES CONSOMMATEURS DOMICILIÉS EN ALLEMAGNE, LES RÈGLES SUIVANTES S’APPLIQUENT : Avant d'exercer les droits conférés au titre de l'article 10.1 (a)-(d), nous vous donnerons un avertissement en y indiquant la violation présumée et en vous accordant une période de trente (30) jours suivant la réception de l’avertissement pendant laquelle vous pouvez remédier à la violation. Nous sommes habilités à exercer nos droits de résiliation au titre de l'article 10.1 (c) ou (d) sans aucun avertissement si on ne peut pas remédier à la violation de façon raisonnable, en raison de sa nature, ou s’il n’est pas raisonnable pour nous d’attendre une période de recours dans les circonstances données, et ce en tenant compte de vos intérêts ainsi que de nos intérêts de manière raisonnable. Vos droits légaux pour une résiliation motivée, ainsi que les nôtres, ne sont pas affectés.

    2. Vous pouvez également résilier ou annuler votre adhésion au Fan Rewards Program en tout temps, en nous contactant comme prévu à l’article 11 ci-dessous.

    3. Si votre adhésion au Fan Rewards Program est suspendue ou résiliée pour tout autre motif (que ce soit par vous ou par nous), en conformité avec les présentes Conditions du Fan Rewards Program, cela entraînera la suspension ou la résiliation de votre droit de participer au Fan Rewards Program. Si votre participation au Fan Rewards Program est résiliée, vous ne pourrez pas réclamer des Points du Fan Rewards Program et vos Points du Fan Rewards Program seront supprimés de votre compte.

  11. RÉCLAMATION, RESPONSABILITÉ, RÈGLEMENT DES CONFLITS, LOI APPLICABLE ET COMPÉTENCE

    1. Pour tout conflit ou toute réclamation que vous avez contre Funko, que Funko a contre vous ou que vous avez, ou Funko a, dans chaque cas se rapportant de quelque façon que ce soit à ces Conditions du Fan Rewards Program ou au Fan Rewards Program, ou à tout aspect de la relation entre vous et Funko ayant trait aux présentes Conditions du Fan Rewards Program ou au Fan Rewards Program, vous acceptez que les dispositions prévues aux Conditions générales s’appliquent.

    1. Die Bedingungen dieses Funko Fan Rewards Programms („Fan Rewards Bedingungen“) gelten für Ihren Zugang zum und Teilnahme am Funko Fan Rewards Programm („Fan Rewards Programm“).

    2. Wenn Sie sich zur Teilnahme am Funko Fan Rewards Programm anmelden, schließen Sie abhängig von Ihrem Wohnsitz/Aufenthalt einen rechtsverbindlichen Vertrag wie folgt ab:

      1. WENN SIE EIN VERBRAUCHER MIT WOHNSITZ/AUFENTHALT IN DEN USA, KANADA ODER MEXIKO SIND – Sie schließen einen rechtsverbindlichen Vertrag mit Funko, LLC ab, einem im Staat Washington, USA unter Firmennummer 602 469 782 eingetragenen Unternehmen mit Geschäftssitz in 2802 Wetmore Avenue, Everett, WA 98201, USA („Funko US“). Das bedeutet, dass Funko US für die Durchführung und den Betrieb des Fan Rewards Programms in Ihrer Gerichtsbarkeit und für alle Aspekte Ihrer individuellen Teilnahme am Fan Rewards Programm verantwortlich ist.

      2. WENN SIE EIN VERBRAUCHER MIT WOHNSITZ/AUFENTHALT IM VEREINIGTEN KÖNIGREICH („UK“) ODER IN DER EUROPÄISCHEN UNION („EU“) SIND - Sie schließen einen rechtsverbindlichen Vertrag mit einer anderen Organisation ab – und zwar Funko UK Limited, das ein in England und Wales unter Firmennummer 10506769 eingetragenes Unternehmen ist, mit MwSt.-Nummer 260 5148 24, und mit eingetragenem Sitz in 21 Holborn Viaduct, London, United Kingdom, EC1A 2DY („Funko UK“). Das bedeutet, dass Funko UK (nicht Funko US) für die Durchführung und den Betrieb des Fan Rewards Programms in Ihrer Gerichtsbarkeit und für alle Aspekte Ihrer individuellen Teilnahme am Fan Rewards Programm verantwortlich ist.

    3. Im Einklang mit dem Vorstehenden bedeutet dies, dass wir entweder Funko US, Funko UK oder beide meinen, wenn wir die Begriffe „Funko“, „wir“, „unser“ oder „uns“ in diesen Geschäftsbedingungen verwenden (abhängig vom Kontext, der aus der Formulierung ersichtlich ist).

    4. Bitte lesen Sie diese Fan Rewards Bedingungen sorgfältig durch. Diese Fan Rewards Bedingungen regeln Ihre Nutzung und Ihren Zugang zum Fan Rewards Programm, und gelten zusätzlich zu Ihren Rechten und Pflichten laut unserer Geschäftsbedingungen. Mit Ihrer Teilnahme am Fan Rewards Programm stimmen Sie diesen Fan Rewards Bedingungen sowie den Geschäftsbedingungen zu. Wenn Sie diesen Fan Rewards Bedingungen und den Geschäftsbedingungen nicht zustimmen, nehmen Sie nicht am Fan Rewards Programm teil.

    5. Gross geschriebene Begriffe, die nicht in den Fan Rewards Bedingungen definiert sind, haben die ihnen in den Geschäftsbedingungen zugewiesene Bedeutung. Diese Fan Rewards Bedingungen sind laut der Geschäftsbedingungen Ergänzende Bedingungen, und das Fan Rewards Programm ist laut Geschäftsbedingungen eine Dienstleistung. Sofern es zwischen diesen Fan Rewards Bedingungen und den Geschäftsbedingungen einen Konflikt gibt, der sich konkret auf die Durchführung des Fan Rewards Programms bezieht, regeln diese Fan Rewards Bedingungen solch einen Konflikt.

    6. Bitte beachten Sie außerdem, dass wir Ihre personenbezogenen Informationen nur gemäß unserer Datenschutzrichtlinie verwenden.

    7. (NUR) FÜR VERBRAUCHER MIT WOHNSITZ/AUFENTHALT IN DEN USA, KANADA ODER MEXIKO: DIE GESCHÄFTSBEDINGUNGEN SCHREIBEN VOR, DASS AUSSER (I) FÜR BESTIMMTE ARTEN VON STREITIGKEITEN, DIE IN ABSCHNITT 24 DER GESCHÄFTSBEDINGUNGEN, BESCHRIEBEN SIND, (II) WENN SIE IHR RECHT ZUM VERZICHT AUF EIN SCHIEDSVERFAHREN, WIE IN ABSCHNITT 24.12 DER GESCHÄFTSBEDINGUNGEN, BESCHRIEBEN, AUSÜBEN ODER (III) SOWEIT GESETZLICH VERBOTEN, STREITIGKEITEN ZWISCHEN IHNEN UND FUNKO INDIVIDUELL GEKLÄRT WERDEN UND NICHT ALS GRUPPENSCHLICHTUNG, GRUPPENKLAGE ODER ANDERE ART VON REPRÄSENTATIVVERFAHREN ODER DURCH SCHWURGERICHTSVERFAHREN.

  2. ÜBERSICHT ÜBER DAS FAN REWARDS PROGRAMM

    Das Fan Rewards Programm ist ein Kundenbindungsprogramm ohne Mitgliedsgebühren. Es ermöglicht Ihnen, durch Abschließen berechtigter Aktivitäten oder Tätigen von Einkäufen, wie in nachstehendem Abschnitt 5 beschrieben, Punkte zu sammeln („Fan Rewards Punkte“). Fan Rewards Punkte können gegen Fan Rewards (Fan-Prämien) eingelöst werden, wie in Abschnitt 6 dieser Fan Rewards Bedingungen beschrieben. Fan Rewards Punkte erlöschen gemäß nachstehendem Abschnitt 8.


  3. QUALIFIKATION

    1. Nur Verbraucher. Nur Verbraucher dürfen unser Fan Rewards Programm nutzen, und das Fan Rewards Programm ist/wird ausschließlich zur persönlichen, nicht kommerziellen Nutzung bestimmt und bereitgestellt. Unternehmen, Verbände oder andere Gruppen oder juristische Personen dürfen nicht am Fan Rewards Programm teilnehmen. Jede Gerichtsbarkeit hat ihre eigene Definition darüber, was ein „Verbraucher“ ist, aber grundsätzlich sind Sie ein Verbraucher, wenn Sie eine natürliche Person sind und wenn Sie zu Zwecken handeln, die ganz oder überwiegend außerhalb Ihres Gewerbes, Geschäfts, Handwerks oder Berufs liegen.

    2. Zur Vermeidung von Missverständnissen und soweit dies nach geltendem Recht zulässig ist, hat Funko gegenüber einem Mitglied keine Haftung für entgangenen Gewinn, Geschäftsverlust, Geschäftsunterbrechung oder Verlust von Geschäftsmöglichkeiten. Dieser Abschnitt 3.2 gilt nicht für Verbraucher mit Wohnsitz/Aufenthalt in Spanien oder Deutschland.

    3. Alter. Benutzer unter achtzehn (18) Jahren (oder dem gesetzlichen Volljährigkeitsalter am Wohnort des Benutzers) dürfen unser Fan Rewards Programm nur unter Aufsicht eines Elternteils oder Erziehungsberechtigten benutzen, der sich mit diesen Fan Rewards Bedingungen einverstanden erklärt. Der Elternteil oder der Erziehungsberechtigte des Benutzers unter achtzehn (18) Jahren (oder dem gesetzlichen Volljährigkeitsalter) ist für die Handlungen oder Unterlassungen jenes Benutzers in Verbindung mit unserem Fan Rewards Programm voll verantwortlich. Wenn Sie ein Elternteil oder Erziehungsberechtigter sind und glauben, dass Ihr Kind im Alter von unter achtzehn (18) Jahren unser Fan Rewards Programm ohne Ihre Einwilligung nutzt, kontaktieren Sie uns bitte unter [email protected].

    4. Gerichtsbarkeit. Sie dürfen sich nur in von uns autorisierten Gerichtsbarkeiten am Fan Rewards Programm anmelden und dieses nutzen. Teilnahme am und Nutzung des Fan Rewards Programms ist gegenwärtig nur in den Vereinigten Staaten, Kanada, Mexiko, dem Vereinigten Königreich (UK), Deutschland, Spanien und einigen anderen EU-Ländern (momentan mit Ausnahme von Italien) autorisiert, wo Funko die Teilnahme am Fan Rewards Programm nach eigenem Ermessen gelegentlich anbieten kann.

  4. IHRE INFORMATIONEN / TEILNAHME AM FAN REWARDS PROGRAMM

    1. Zur Teilnahme am Fan Rewards Programm müssen Sie bei uns ein Konto erstellen oder haben, und sich für das Fan Rewards Programm auf unserer Webseite unter https://www.funko.com/fanrewards registrieren.

    2. Nach Anmeldung am Fan Rewards Programm können Sie Ihre Fan Rewards Punkte durch Ihr Konto bei uns einsehen und verwalten. Für weitere Informationen bezüglich Ihres Kontos und für Ihr Konto geltende Einschränkungen lesen Sie bitte unsere Geschäftsbedingungen.

  5. SAMMELN VON FAN REWARDS PUNKTEN

    1. Sie können mit dem Sammeln von Fan Rewards Punkten beginnen, sobald Sie sich am Fan Rewards Programm angemeldet haben, indem Sie:

      1. an qualifizierenden Werbeaktivitäten oder anderen Möglichkeiten teilnehmen, die wir gelegentlich anbieten. Fan Rewards Punkte für die Teilnahme an Werbeaktivitäten werden, wie im jeweiligen Werbeangebot und relevanten Bedingungen beschrieben, vergeben und

      2. Sie können auch Fan Rewards Punkte sammeln, indem Sie durch unsere Dienstleistungen qualifizierende Einkäufe tätigen. Fan Rewards Punkte für Einkäufe werden, wie in den relevanten Bedingungen für den jeweiligen Einkauf beschrieben, vergeben.

    2. Qualifizierende Werbeangebote und Einkäufe können zusätzlichen Bedingungen unterliegen. Bitte lesen Sie die zusätzlichen Bedingungen, die für jedes qualifizierende Werbeangebot und qualifizierenden Einkauf geltenden. Wenn die Bedingungen für ein qualifizierendes Werbeangebot oder qualifizierenden Einkauf im Widerspruch mit diesen Fan Rewards Bedingungen stehen, gelten die Bedingungen des jeweiligen Werbeangebots. Es gelten bestimmte Ausschlüsse, wie nachstehend in Abschnitt 5.4 beschrieben.

    3. Im Allgemeinen werden Fan Rewards Punkte Ihrem Konto innerhalb von vierundzwanzig (24) Stunden nach Auftreten und Abschluss der jeweiligen Werbeaktion oder des Kaufs gutgeschrieben, es sei denn, es gilt ein nachstehend aufgeführter Ausschluss.

    4. Ausschlüsse.

      1. Fan Rewards Punkte können nur für qualifizierende Werbeaktivitäten verdient werden, die Sie persönlich unternommen haben, oder qualifizierende Einkäufe, die Sie persönlich getätigt haben, sofern nichts anderes schriftlich von uns angegeben wurde.

      2. Sie können keine Fan Rewards Punkte auf Käufe von Geschenkgutscheinen, Steuern, Trinkgelder, Aktionsrabatte, Einkäufe, die durch Einlösen Ihrer Fan Rewards getätigt wurden, sowie andere Artikel verdienen, die wir von Zeit zu Zeit festlegen können.

      3. Fan Rewards Punkte werden nicht auf betrügerische, zurückgesandte, erstattete oder stornierte Werbeaktivitäten oder Einkäufe gewährt.

      4. Wenn eine Werbeaktivität, mittels welcher Sie Fan Rewards Punkte verdient haben, von Ihnen storniert wird, oder Sie an solch einer Werbeaktivität nicht teilnehmen, oder wenn Sie einen Artikel zurücksenden oder eine Rückerstattung für einen Artikel erhalten, der Ihnen Fan Rewards Punkte verdient hat, dann werden jegliche Fan Rewards Punkte, die Sie aufgrund der jeweiligen Werbeaktivität bzw. des jeweiligen Einkaufs gesammelt haben und die Ihrem Fan Rewards Punktestand hinzugefügt wurden, automatisch von Ihrem Fan Rewards Punktestand abgezogen und von Ihrem Konto entfernt.

      5. Die im Rahmen des Fan Rewards Programm gesammelten Fan Rewards Punkte sind persönlich und werbebezogen. Das bedeutet, dass diese keinen Barwert haben, nicht verkauft, Ihnen nicht in bar ausgezahlt und nicht an eine andere Person übertragen/von einer anderen Person benutzt werden können.

      6. Fan Rewards Punkte können nur wie in diesem Abschnitt 5 erklärt, verdient werden und dürfen nicht gekauft (oder auf andere Weise verdient) werden.

  6. NUTZUNG ODER EINLÖSUNG VON FAN REWARDS PUNKTEN

    1. Fan Rewards Punkte dürfen für Artikel oder für Werbeaktivitäten oder andere Möglichkeiten eingelöst werden, die wir in Abständen anbieten („Fan Rewards“). Es kann sein, dass nur eine begrenzte Anzahl eines bestimmten Fan Rewards verfügbar ist, und jene Fan Rewards werden nach dem Prinzip „Wer zuerst kommt, mahlt zuerst“ geliefert. Es gelten bestimmte Nutzungsbeschränkungen, wie nachstehend beschrieben.

    2. Nutzungseinschränkungen.

      1. Fan Rewards Punkte können nicht für frühere Bestellungen benutzt oder eingelöst werden.

      2. Es ist auch nicht möglich, Fan Rewards Punkte während der gleichen Transaktion zu nutzen oder einzulösen, in welcher sie verdient wurden, sofern nicht ausdrücklich schriftlich von uns angegeben.

      3. Im Zusammenhang mit einem Fan Reward sind Sie für alle Steuern für einen Artikel verantwortlich, den Sie mit Fan Rewards Punkten kaufen.

      4. Fan Rewards können bestimmte Einschränkungen haben, wie Verfallsdaten und kurze, zeitlich begrenzte Einlösefristen, die durch Bedingungen geregelt sind, die zusätzlich zu diesen Fan Rewards Bedingungen gelten. Bitte lesen Sie die für jeden Fan Reward geltenden Bedingungen sorgfältig durch.

    3. Vorausgesetzt, dass wir Sie mindestens dreißig (30) Tage im Voraus informieren:

Die Anzahl an Fan Rewards Punkten, die zum Einlösen eines Fan Rewards notwendig sind, kann wesentlich erhöht werden, jeglicher Fan Reward kann gestrichen werden und es können von uns oder einem unserer Beauftragten oder dem externen Geschäftspartner, welcher den Fan Reward liefert, Einschränkungen auf den Fan Reward oder dessen Einlösung auferlegt werden.

      2. Wir behalten uns auch das Recht vor, Fan Rewards mit Fan Rewards von vergleichbarem oder höherem Wert zu ersetzen, wenn eingelöste Fan Rewards aus einem beliebigen Grund nicht länger verfügbar sind.

      3. Fan Rewards, die am Point-of-Sale, online, in Fernseh- und Printwerbung, Werbepaketen und anderen Materialien des Fan Rewards Programms abgebildet sind, dienen nur zur Veranschaulichung. Der tatsächliche Fan Reward kann vom abgebildeten Fan Reward abweichen.

      4. Dieser Abschnitt 6.3 gilt nicht für Verbraucher mit Wohnsitz in Deutschland.

  7. RÜCKGABEN, STORNIERUNGEN UND NICHTERSCHEINEN

    1. Wenn Sie Fan Rewards Punkte für einen Fan Reward benutzen oder einlösen, der eine Ware ist (und nicht eine Dienstleistung) – dürfen Sie solche Waren nicht zurücksenden oder für diese eine Rückerstattung erhalten.

    2. Wenn Sie Fan Rewards Punkte für eine Werbeaktivität benutzen oder einlösen, die von uns storniert wird (unter den begrenzten, durch diese Fan Rewards Bedingungen gestatteten Umständen), werden jegliche Fan Rewards Punkte, die von Ihrem Fan Rewards Punktestand für die jeweilige Werbeaktivität abgezogen wurden, automatisch Ihrem Fan Rewards Punktestand wieder hinzugefügt. Wenn Sie jedoch an einer Werbeveranstaltung, für welche Sie Fan Rewards Punkte benutzt oder eingelöst haben, nicht teilnehmen, werden Fan Rewards Punkte, die von Ihrem Fan Rewards Punktestand für die jeweilige Werbeaktivität abgezogen wurden, Ihrem Fan Rewards Punktestand NICHT wieder hinzugefügt.

  8. FAN REWARDS PUNKTE – ABLAUF UND LÖSCHUNG

    1. Ablauf.

      1. Falls Sie für einen Zeitraum von einem (1) Jahr keine Fan Rewards Punkte verdienen oder einlösen, erlöschen alle Ihrer unbenutzten Fan Rewards Punkte. Erloschene Fan Rewards Punkte werden von Ihrem Fan Rewards Punktestand abgezogen und von Ihrem Fan Rewards Konto entfernt. Funko wird Ihnen dreißig (30) Tage vor Erlöschen der Fan Rewards Punkte eine E-Mail an die E-Mail-Adresse senden, die Sie während der Registrierung angegeben haben. NUR FÜR VERBRAUCHER MIT AUFENTHALT IN DEUTSCHLAND GILT FOLGENDES ANSTELLE DES VORSTEHENDEN: Das Verfallsdatum ist nicht ein (1) Jahr, sondern drei (3) Jahre, beginnend am Ende des Jahrs, in welchem Sie die relevanten Fan Rewards Punkte verdient haben, welche vom Ablauf betroffen sind.

      2. Siehe auch nachstehenden Abschnitt 9 dieser Fan Rewards Bedingungen für Informationen darüber, welche Auswirkungen eine Suspension oder Beendigung Ihrer Teilnahme am Fan Rewards Programm auf Ihre Fan Rewards Punkte hat.

      3. Sie können die für Ihre Fan Rewards Punkte verbleibende Gültigkeitsdauer prüfen, indem Sie uns unter [email protected] kontaktieren.

    2. Löschung. Funko kann mit Ausnahme der nachstehenden Bestimmungen unter den folgenden Umständen Fan Rewards Punkte von Ihrem Konto und ohne vorherige Ankündigung löschen,:

      1. wenn Fan Rewards Punkte aufgrund Ihrer schuldhaften Verletzung dieser Fan Rewards Bedingungen (oder unserer Geschäftsbedingungen) gutgeschrieben wurden, zum Beispiel aufgrund Ihres Missbrauchs oder betrügerischen Handelns.

      2. wenn Fan Rewards Punkte gutgeschrieben wurden für eine Bestellung/einen Kauf, die/der aus einem jedweden Grund teilweise oder vollständig rückerstattet wurde, und im Falle einer teilweisen Rückerstattung werden nur die Fan Rewards Punkte für den Betrag der teilweisen Rückerstattung abgezogen.

  9. ÄNDERUNGEN ZU DIESEN FAN REWARDS BEDINGUNGEN / DEM FAN REWARDS PROGRAMM

    1. Wir behalten uns das Recht vor, das Fan Rewards Programm sowie alle oder einen Teil dieser Fan Rewards Bedingungen oder jeglicher für das Fan Rewards Programm geltenden Richtlinien jederzeit und nach eigenem Ermessen zu ändern oder abzuschaffen (wenn es zum Beispiel eine Änderung der Gesetze oder unserer Geschäftstätigkeit gibt). Wir können die Leistungen des Fan Rewards Programms einstellen oder ändern oder das Fan Rewards Programm mit einem anderen Treue- oder Prämienprogramm verschmelzen (wenn es zum Beispiel eine Änderung der Gesetze oder unserer Geschäftstätigkeit gibt). In jedem der vorgenannten Fälle werden wir Sie mindestens dreißig (30) Tage vor der Vornahme von Änderungen im Voraus benachrichtigen und wir werden die ergänzten Fan Rewards Bedingungen posten und das oben angegebene „Zuletzt aktualisierte“ Datum aktualisieren. Wenn Sie den ergänzten Fan Rewards Bedingungen nicht zustimmen, müssen Sie Ihre Teilnahme am Fan Rewards Programm einstellen – Sie haben die Möglichkeit zu entscheiden, ob Sie weiterhin am Fan Rewards Programm teilnehmen oder Ihre Mitgliedschaft kündigen möchten (was Sie in Ihrem Konto tun können oder indem Sie uns unter [email protected] kontaktieren). Ihre fortgesetzte Teilnahme am Fan Rewards Programm nach Ablauf der Frist von dreißig (30) Tagen gilt als Ihre bestätigte Annahme der Änderungen.

    2. FÜR VERBRAUCHER MIT AUFENTHALT IN DEUTSCHLAND: Abschnitt 9.1 gilt für Sie nicht, und dieser Abschnitt 9.2 gilt stattdessen für Sie. Wir können ohne Ihre Zustimmung das Fan Rewards Programm (inklusive durch Einstellen oder Ändern der Leistungen des Fan Rewards Programms oder Zusammenlegung des Fan Rewards Programms mit einem anderen Treue- oder Prämienprogramm) oder diese Fan Rewards Bedingungen oder jegliche Richtlinien in Bezug auf das Fan Rewards Programm nicht ändern.

  10. KÜNDIGUNG UND SUSPENSION

    1. Wenn Sie eine dieser Fan Rewards Bedingungen verletzen, behalten wir unsere Rechte (vorbehaltlich geltendem Recht) vor, unverzüglich alle oder eine der folgenden Aktionen durchzuführen (ohne Einschränkung):

      1. eine Warnung an Sie auszusprechen;

      2. vorübergehend oder dauerhaft jeglichen, von Ihnen auf die Dienstleistungen hochgeladenen Benutzerinhalt zu entfernen (falls zutreffend);

      3. vorübergehend oder dauerhaft Ihr Recht zur Nutzung der Dienstleistungen, inklusive des Fan Rewards Programms aber auch der Funko Dienstleistungen im weiteren Sinne, zu entziehen;

      4. Ihr Funko-Konto zu suspendieren oder aufzulösen;

      5. rechtliche Schritte gegen Sie einzuleiten, um die Erstattung aller Kosten zu fordern, die sich aus dem Verstoß ergeben (einschließlich, aber nicht beschränkt auf angemessene Verwaltungs- und Rechtskosten);

      6. weitere rechtliche Schritte gegen Sie einzuleiten; und/oder

      7. diese Informationen bei Bedarf an Strafverfolgungsbehörden weiterzugeben (vorbehaltlich geltender Datenschutzgesetze).

      2. FÜR VERBRAUCHER MIT AUFENTHALT IN DEUTSCHLAND GILT FOLGENDES: Vor Ausübung der Rechte laut Abschnitt 10.1 (a)-(d) werden wir Ihnen eine Abmahnung unter Angabe des mutmaßlichen Verstoßes zukommen lassen und Ihnen eine Frist von dreißig (30) Tagen ab Erhalt der Mitteilung gewähren, innerhalb derer Sie den Verstoß beheben können. Wir sind zur Ausübung unserer Kündigungsrechte laut Abschnitt 10.1 (c) oder (d) ohne Abmahnung berechtigt, wenn der Verstoß seiner Natur nach nicht angemessen behoben werden kann oder wenn uns unter den gegebenen Bedingungen und unter angemessener Berücksichtigung Ihrer und unserer Interessen das Abwarten einer Frist zur Abhilfe nicht zugemutet werden kann. Ihre und unsere gesetzlichen Rechte zur Kündigung aus wichtigem Grund bleiben unberührt.

    2. Sie können Ihre Teilnahme am Fan Rewards Programm auch jederzeit kündigen oder stornieren, indem Sie uns gemäß nachstehendem Abschnitt 11 kontaktieren.

    3. Wenn Ihre Teilnahme am Fan Rewards Programm aus anderen Gründen (von uns oder von Ihnen) gemäß diesen Fan Rewards Bedingungen suspendiert oder beendet wird, führt dies zur Suspension oder Kündigung Ihrer Teilnahme am Fan Rewards Programm. Wenn Ihre Teilnahme am Fan Rewards Programm gekündigt wird, können Sie keine gesammelten Fan Rewards Punkte einlösen, und Ihre Fan Rewards Punkte werden von Ihrem Konto gelöscht.

  11. BESCHWERDEN, HAFTUNG, STREITBEILEGUNG, GELTENDES RECHT UND GERICHTSBARKEIT

    1. Für jegliche Streitigkeiten oder Ansprüche, die Sie gegen Funko haben, die Funko gegen Sie hat, oder die Sie haben, oder die Funko hat, die in jedem Fall mit diesen Fan Rewards Bedingungen oder dem Fan Rewards Programm in Zusammenhang stehen, oder jeglichem Aspekt der Beziehung zwischen Ihnen und Funko in Bezug auf diese Fan Rewards Bedingungen oder das Fan Rewards Programm, erkennen Sie an, dass die in den Geschäftsbedingungen aufgeführten Bestimmungen gelten.
